Po co nam Twoje dane osobowe?

Przetwarzamy Twoje dane osobowe w związku z realizacją następujących celów:

• zawarcia i wykonania umowy ubezpieczenia, w tym dokonania oceny ryzyka ubezpieczeniowego – podstawą prawną przetwarzania jest niezbędność przetwarzania danych do zawarcia i wykonywania umowy,
• wypełnienia przez administratora danych obowiązków związanych z przeciwdziałaniem praniu pieniędzy oraz finansowaniu terroryzmu – podstawą prawną przetwarzania danych jest niezbędność do wypełnienia obowiązku prawnego ciążącego na administratorze,
• ewentualnego dochodzenia roszczeń związanych z zawartą z Twoją umową ubezpieczenia – podstawą prawną przetwarzania danych jest niezbędność przetwarzania do realizacji prawnie uzasadnionego interesu administratora; uzasadnionym interesem administratora jest możliwość dochodzenia przez niego roszczeń,
• ewentualnego podejmowania czynności w związku z przeciwdziałaniem przestępstwom ubezpieczeniowym – podstawą prawną przetwarzania danych jest niezbędność przetwarzania do realizacji prawnie uzasadnionego interesu administratora; uzasadnionym interesem administratora jest możliwość przeciwdziałania i ściganie przestępstw popełnianych na szkodę Zakładu Ubezpieczeń,
• reasekuracji ryzyk – podstawą prawną przetwarzania danych jest niezbędność przetwarzania do realizacji prawnie uzasadnionego interesu administratora; uzasadnionym interesem administratora jest zmniejszenie ryzyka ubezpieczeniowego związanego z umową zawartą z Tobą;

Kto może mieć dostęp do Twoich danych?

Możemy przekazywać Twoje dane innym podmiotom (odbiorcom), aby w sposób prawidłowy realizować zawartą z Tobą umowę i zapewnić odpowiednią organizację przedsiębiorstwa. 

Odbiorcami będą w szczególności dostawcy rozwiązań informatycznych, podmioty wspierające nas w procesie likwidacji szkód oraz windykacji należności, agenci ubezpieczeniowi, zakłady reasekuracji, call center czy agencje i firmy marketingowe. Z każdym z tych podmiotów zawarliśmy stosowne umowy, w których nałożyliśmy na nich szczególne obowiązki związane z przetwarzaniem i ochroną Twoich danych. 

Niektóre z tych podmiotów mogą mieć siedzibę poza Europejskim Obszarem Gospodarczym. Transfer danych do tych krajów odbywa się w oparciu o standardowe klauzule umowne wydane przez Komisje Europejską lub odpowiednią decyzje Komisji Europejskiej. Przysługuje Ci prawo uzyskania kopii ww. klauzul – wniosek możesz złożyć na adres iod@nn.pl

Jakie masz prawa w związku z przetwarzaniem danych?

W związku z przetwarzaniem Twoich danych osobowych, przysługują Ci następujące prawa:

• dostępu do swoich danych oraz możesz zażądać, żebyśmy je sprostowali, np. jeśli okaże się, że jest w nich błąd, lub gdy zmienisz numer telefonu czy adres,
• być zapomnianym – możesz więc zażądać, abyśmy usunęli Twoje dane,
• złożenia tzw. sprzeciwu wobec przetwarzania Twoich danych, w tym w celu marketingowym, 
• żądania, abyśmy ograniczyli ich przetwarzanie,
• otrzymać od nas swoje dane osobowe – przekażemy je w powszechnie odczytywanym formacie (np. PDF) Tobie lub innemu administratorowi danych, którego wskażesz
• wnieść skargę do organu nadzorczego, który zajmuje się ochroną danych osobowych. W Polsce jest to Prezes Urzędu Ochrony Danych Osobowych.
   

Zautomatyzowane podejmowanie decyzji 

W związku z przetwarzaniem Twoich danych osobowych nie zachodzi zautomatyzowane podejmowanie decyzji, w tym profilowanie.
 

Okres przetwarzania danych 

Twoje dane osobowe będą przetwarzane do momentu przedawnienia roszczeń z tytułu umowy ubezpieczenia oraz innych roszczeń lub do momentu wygaśnięcia obowiązku przechowywania danych wynikającego z przepisów prawa, w szczególności obowiązku przechowywania dokumentów księgowych dotyczących umowy ubezpieczenia.

Podanie danych

Podanie danych jest dobrowolne, ale niezbędne do zawarcia i wykonania umowy oraz oceny ryzyka.

Why Do we Need Your Personal Data?

We process your personal data in connection with the following purposes:

• conclusion and performance of the insurance contract, including insurance risk assessment – the legal grounds for processing is the necessity of data processing to conclude and perform the contract,
• fulfilment by the data controller of obligations related to counteracting money laundering and terrorist financing practices – the legal grounds for data processing is the necessity to fulfil the legal obligation incumbent on the controller,
• possible pursuit of claims related to the insurance contract concluded with you – the legal grounds for data processing is the necessity of processing to exercise the legitimate interest of the controller; the legitimate interest of the controller is the possibility of pursuing claims by them,
• activities regarding counteracting insurance crimes – the legal grounds for data processing is the necessity of processing to exercise the legitimate interest of the controller; the legitimate interest of the controller is the possibility of preventing and prosecuting crimes committed to the detriment of the Insurance Undertaking,
• reinsurance of risks – the legal grounds for data processing is the necessity of processing to exercise the legitimate interest of the controller; the legitimate interest of the controller rests with the reduction of the insurance risk related to the contract concluded with you.
   

Who Can Access Your Data?

We may transfer your data to other entities (recipients) in order to duly perform the contract concluded with you and to ensure the proper organisation of the company. 

The recipients include, in particular, provider of IT solutions, entities supporting us in the claims handling and debt collection process, insurance agents, reinsurance companies, call centres, or marketing agencies and companies. We have concluded relevant agreements with each of these entities, in which we imposed on them specific obligations related to the processing and protection of your data. 

Some of these entities may be based outside the European Economic Area. Data to these countries is transferred based on standard contractual clauses issued by the European Commission or the relevant decision of the European Commission. You have the right to obtain a copy of the above-mentioned clauses – you can submit the application to the address iod@nn.pl
 

What Rights Do You Have in Connection with Data Processing?

In connection with the processing of your personal data, you have the following rights:

• the right to access to your data and to request that we correct it, e.g. if it turns out that there is an error in it, or if you change your telephone number or address,
• the right to be forgotten – therefore, you can request that we delete your data,
• the right to submit the objection to the processing of your data, including for marketing purposes, 
• the right to request that we restrict processing of Your personal data,
• the right to data portability – we will provide it in a commonly read format (e.g. PDF) to you or another data controller you indicate,
• the right to lodge a complaint with the supervisory authority that deals with the protection of personal data. In Poland, this is the President of the Office for Personal Data Protection.
   

Automated Decision Making 

In connection with the processing of your personal data, there is no automated decision making, including profiling.

Data Processing Period 

Your personal data will be processed until the claims under the insurance contract and other claims expire, or until the obligation to retain data under the law expires, in particular the obligation to retain accounting documents regarding the insurance contract.
 

Providing Data

Providing data is voluntary, yet necessary for the conclusion and performance of the contract and risk assessment.
